Terms & Condition

This is the agreement made between the owner and the hirer, acknowledged and agreed as follows:

VEHICLE DESCRIPTION AND TERM OF HIRE

1. General

  • 1.a. Only the people listed on as authorised drivers will drive thevehicle.
  • 1.b. Everyone driving the vehicle must have a valid full NZ oroverseas driving licence (translated into English if necessary)that is required for the class of vehicle.
  • 1.c. No minimum or maximum age restriction applies.
  • 1.d. Rent A Car has the right to request two recent address proof
  • 1.e. Daily hire charges are calculated on a per twenty-four hour daybasis.

2. Disputes

  • 2.a. If you believe you have been incorrectly charged or you haveany other complaint about your experience, you must informus in writing within 20 working days.
  • 2.b. Where your booking has been made through a third partyagency, we are not responsible for refund requests related toyour booking. The hirer must contact the third party agencythe booking was made through directly.
  • 2.c. We will aim to resolve all complaints amicably and in goodfaith and try to settle all disputes within 21 days.

3. Your Obligations

Payment

  • 3.a. You will pay the amount specified on your Rental Agreementto us
  • 3.b. You may also be liable for any relevant additional charges for:

3.b.1. Fuel;

  • 3.b.2. Returning the vehicle later than the agreed time;
  • 3.b.3. Damage to or repair of the vehicle, and enforcementcharges related to this;
  • 3.b.4. Traffic fines, infringement fees, and any administrationcost we have to pay in relation to this; and/or

3.b.5. Toll charges.

  • 3.c. At the start of the hire you must provide us with your credit/debit card details. The credit/debit card must be in the nameof the main hirer (i.e. the embossed text must state the mainhirer’s name). We reserve the right to refuse a hire if the mainthe driver does not have a credit/debit card in their name. At ourdiscretion, we may accept a credit/debit card that does nothave the main hirer’s name embossed where a the hirer is ableto prove that the card is in their name (for example, throughyour online banking records). We may put a hold on your creditcard or debit card up to the total value of the hire. If any lossoccurs, we will charge the loss based on the actual costs toyour credit card or debit card.
  • 3.c.1. There is no deposit required to secure your booking with us.Full payment is taken on the day the rental period commences. For after-hours collections, payment is taken the working dayprior to rental commencement. If the hirer cancels the bookingprior to collection then the cancellation policy will apply.
  • 3.c.2. Our preferred payment methods are by credit card or cashwhich must be in NZD. When paying by credit card, a 3.0%surcharge applies for all Visa or MasterCard transactions and a5% surcharge applies for any American Express transactions.

How To Use The Vehicle

3.c.3. You must never:

  • 3.c.4. Use or let anyone else use the vehicle to transportpassengers for hire or reward unless you let us know inwriting, and you are appropriately licensed under Part4A of the Land Transport Act 1998 (“the Act”);
  • 3.c.5. Sublet or hire the vehicle to anyone else 3.7.1.2 Allowthe vehicle to be used outside of our authority;
  • 3.c.6. Drive or let anyone else drive the vehicle in breach ofsections 56, 57, 57AA, 57A or 58 of the Act;
  • 3.c.7. Drive or let anyone else drive the vehicle in any race,speed test, rally or contest;
  • 3.c.8. Use the vehicle or let anyone else use the vehicle inbreach of the Act, the Land Transport (Road User) RuleRent A Car Terms And Conditions2004, the Freedom Camping Act 2011, or any otherAct, regulation, rule or bylaw about road traffic;3.c.8. Use the vehicle or let anyone else use the vehicle totransport more passengers or goods than set in thecertificate of loading and/or RUC certificate (whicheversets less);
  • 3.c.9. Drive the vehicle or let anyone else drive the vehicle onany beach, driveway, or surface likely to damage tovehicle; or
  • 3.c.10. Carry pets or animals inside the vehicle unless they areapproved service animals.
  • 3.c.11. It is your responsibility to ensure that:
  • 3.c.12. You take reasonable care when driving and parking thevehicle;
  • 3.c.13. You maintain the water in the vehicle’s radiator andbattery at the proper level;
  • 3.c.14. You maintain the oil in the vehicle at the proper level;
  • 3.c.15. You maintain the tyres at the proper pressure;
  • 3.c.16. The vehicle is secure and locked whenever it is notbeing used;
  • 3.c.17. Nobody interferes with the distance recorder orspeedometer;
  • 3.c.18. Nobody interferes with any part of the engine,transmission, braking or suspension systems;
  • 3.c.19. If a warning light appears, or you believe the vehicleneeds mechanical attention, you stop driving andcontact us at once
  • 3.c.20. You keep a copy or have access to a digital copy of theRental Agreement in the vehicle during the hire.

The excess applicable depends on the excess option you choose:

  • 1. Premium Comprehensive Protection Cover: $Nil excess bond $1000 required
  • 2. Plus: $750.00
  • 3. Basic: $1500.00
  • 4. Personal:$2500.00

The cost of reducing the excess applicable is as follows:

  • 1. Premium: $45.00 per day, up to a maximum 60days
  • 2. Plus: $29.00 per day, up to a maximum 60 days
  • 3. Basic: $15.00 per day,up to maximum 60 days
  • 4. Personal: $0 per day,up to maximum 60 days
  • 5. Restricted License (P Plates) Insurance: Restricted or PPlate Licence holders are required to take out ourRestricted License (P Plates) Insurance with their hireat the cost of NZ$34.00 per day (to a maximum 7 days. Premium Comprehensive Protection Cover is included within this insurance).

Regardless of whether you have chosen Premium Comprehensive Protection Cover, you will not be covered for any loss if:

  • 1. You or anyone driving the vehicle is under the influenceof any intoxicating substance, drug or alcohol;
  • 2. The vehicle is used in an unsafe or damaged condition,and the person driving the vehicle was or should havebeen aware of this;
  • 3. You or anyone else drives the vehicle in any race, speedtest, rally, hill climbing or contest;
  • 4. Anyone drives the vehicle who is not named on page 1of the Rental Agreement, or does not have a valid andfull drivers licence;
  • 5. You or anyone else driving the vehicle causes any lossor damage by committing any intentional or recklessact or omission, including a reckless or intentionalserious traffic offence;
  • 6. You or anyone else drives the vehicle on any beach,riverbed, or private road;
  • 7. Damage is caused due to unlawful driving
  • 8. The driver receives a charge of reckless or dangerousdriving by the New Zealand Police
  • 9. Damage is caused when these terms and conditionsare breached
  • 10. Damage is caused due to negligence or wilful conduct
  • 11. Damage is caused due to the use of incorrect orcontaminated fuel
  • 12. Damage is caused due to using the vehicle incontravention of any legislation or regulation
  • 13. Insurance options do not cover loss or damage toaccessories hired
  • 14. Vehicle rollover
  • 15.Underbody damage
  • 16.Overbody damage
  • 17. Any loss of, or damage to any property stolen from thevehicle or otherwise lost or damaged during the rental

4. Mechanical Faults

  • 4.1. The hirer shall take all reasonable care to ensure that thevehicle is properly maintained during the hire period. Thisshall include daily checks of the oil, water and battery.
  • 4.2. The vehicle is covered by 24 hour, 7 days, road-side assistanceat the cost of the hirer. If the hirer has chosen Premium coverComprehensive Protection Cover then the cost of the road side assistance is included.
  • 4.3. If the vehicle has any mechanical failures during the hire theseissues must be reported to the Rent A Car as soon aspossible in order to give Rent A Car the opportunity torectify the issues during the rental.
  • 4.4. The hirer is not entitled to any refund unless Rent A Car hasbeen advised of the issue, and has been given the opportunityto rectify the situation.
  • 4.5. A refund can be requested from Rent A Car if a breakdownhas directly caused a delay in travel in one location of 48hours or more.
  • 4.6.Rent A Car is not liable for any delay in repair caused by abreakdown occurring on a weekend or public holiday.

5. Refunds

  • 5.1. Any potential refund for a breakdown of the vehicle is limitedto the daily rental rate of the vehicle for each day.
  • 5.2. For the avoidance of doubt, Rent A Car is not liable for anycosts the hirer incurs due to the breakdown including but notlimited to substitute rental vehicle, accommodation costs,and any other costs associated due to the breakdown unlessotherwise stated in these terms and conditions.
  • 5.3. Rent A Car does not accept any liability for currencyexchange rate fluctuations.
  • 5.4. All refunds are subject to a processing period of up to 25working days from the date the vehicle was returned to Rent A Car.

6. Amendments

  • 6.1. If an amendment is made to the hire dates within 3 days priorto collection or during the hire, no refund will be made if thelength of the hire is decreased (that is, the rental will becharged at the number of days originally booked).
  • 6.2. If the hirer wishes to extend the rental whilst on hire, theymust first obtain authorisation from Rent A Car
  • 6.3. Any extension is subject to fleet availability and Rent A Car will advise of the additional cost.
  • 6.4. Failure to obtain authorisation (i.e. a late return) will result inthe hirer being charged the daily rate plus an additionalNZ$200 for each day.
  • 6.5. If the hirer wishes to change the pick up or drop off locationafter confirmation of the booking, or during the hire period,Authorisation from Rent A Car must be obtained.
  • 6.6. Subject to the change being approved, an additional chargeof NZ$750 may apply.
  • 6.7. If the vehicle is returned early for any reason there is norefund available for the unused portion of the hire.

7. Fuel

  • 7.1. All vehicles are supplied with a full tank of fuel andaccordingly, all vehicles must be returned with a full tank offuel.
  • 7.2. If the vehicle is returned without a full tank of fuel, the hireris liable for the cost of the fuel, plus a fee of NZ$25.00.

8. Infringement Offences

8.1. You will be liable for the following infringement offencescommitted during the hire

  • 8.1.1. A speeding offence,
  • 8.1.2.A toll offence,
  • 8.1.3. An offence for not keeping to a traffic signal direction,detected by vehicle surveillance equipment
  • 8.1.4.An offence for parking on a road that breaches anybylaw or road controlling authority
  • 8.1.5.Any parking tickets whether issued by the respectivebody including but not limited to Council, Police orprivate company
  • 8.1.6. An offence against Part 6 of the Land Transport (RoadUser) Rule 2004, or
  • 8.1.7.An offence under section 20(1) of the FreedomCamping Act 2001.

8.2. If you commit an infringement offence, you must pay anyinfringement fee and costs due.

  • 8.3. After receiving an infringement notice, we will transferliability for the offence from us as the registered owner of thevehicle to you as the driver, providing the relevantinfringement authority with your name, address, date of birthand driver licence number. We will charge an administrationfee of up to $50.00 per infringement to cover the cost oftransferring liability.
  • 8.4. If we are unable to transfer liability (e.g. if the infringementdoesn’t allow liability to be transferred, or if we do not holdall information necessary to transfer liability), thecredit/debit card held on file will be charged for the amountof the infringement fee plus a $50.00 administration fee.
  • 8.5. You have the right to challenge, complain about, query orobject to the alleged offence to the relevant issuinginfringement authority. If you are successful at having theinfringement reversed, any administration fee that we havecharged in relation to your infringement is not able to berefunded.
  • 8.6. If, as at the completion date of your rental agreement, anycosts associated with your rental have not been paid, orsubsequent to this completion date you become liable foradditional costs in relation to your rental agreement, wereserve the right to refer your account to a debt collectionagency.
  • 8.7. In these circumstances, and solely at our discretion, you maybecome liable for all costs incurred by us in relation to thecollection of this debt (including but not limited to internaladministration fees, legal fees, collection agency fees, andbank fees).

14. Your Rights

  • 14.1. You are entitled to:
  • 14.1.1.Challenge or complain about the alleged offence to theenforcement authority that sent the infringementnotice, and
  • 14.1.2.Seek a court hearing, either within 56 days from thedate the infringement notice was given, or 28 daysfrom the date the reminder notice was given.

15. Other Extra Fees and Charges

  • 15.1. Cleaning Fee: If the vehicle is not returned in a tidy condition,a fee of $200.00 will apply
  • 15.2. Smoking Fee: If any person smokes inside and/or around thevehicle, a fee of $200.00 will apply.
  • 15.3. Pet Fee: If pets are found to have been in the vehicle, a$200.00 cleaning fee will apply.
  • 15.4. Call-out Fee: If Personal or Basic cover is selected androadside assistance is required, the hire will be liable for theroadside assistance provider’s call-out fee where the call outis due to driver error. This includes, but is not limited to: flatbattery due to driver error (e.g. lights left on, door left openetc); customer has run out of petrol; anything else related todriver error, accidents etc. If assistance is required purely dueto mechanical breakdown, the call out fee will be covered byus.
  • 15.5. Towing Charge: when the vehicle is required to be towed dueto human error, the hirer will be liable for the cost of towingthe vehicles. This includes but is not limited to: accidents(regardless of who is at fault), flat batteries due to hirer error(lights left on, door open etc), wrong fuel in the tank, etc. Ifthe tow is required due to mechanical breakdown, the cost ofthe tow will be covered by us.

16. Other

16.1. Rent A Car reserves the right to amend these terms andconditions, vehicle specifications and tariffs at any timewithout prior notice. Rent A Car reserves the right to refuseany rental at its own discretion.

16.2. The Hirer agrees that Rent A Car shall have the right torefuse any rental and/ or terminate the hire and takeimmediate possession of the Vehicle, without notification tothe Hirer, if:

  • 16.2.1. the Hirer fails to comply with any of the material termsand conditions of this Agreement,
  • 16.2.2. the Hirer has obtained the Vehicle through fraud ormisrepresentation;
  • 16.2.3. if the Vehicle is damaged; or
  • 16.2.4.in the reasonable opinion of Rent A Car and/or theNZ Police the Authorised Driver(s) do not havesufficient skill or experience to operate the Vehicle in asafe manner or the safety of the passengers or theVehicle is at risk.

16.3. In such event the Hirer will:

  • 16.3.1. not be entitled to a refund of part of the rental charges;and
  • 16.3.2.be responsible for the payment of any towing costs toreturn the Vehicle to the Return Location plus a fee tocover the reasonable costs of Rent A Car in arrangingthe return of the Vehicle. This includes the extensionof the hire if the vehicle cannot be recovered to a Rent A Car depot by the completion of the hire.

17. CREDIT CARD & EXTRA DRIVE FEE

17.1. Payment Requirements:

  • Card Fee: A card fee of 2.5% will be charged for all transactions processed via credit card.
  • Extra Drive Fee: An additional fee of 2.5% per mile/kilometer will apply for any mileage or distance driven beyond the agreed limit in your rental agreement.

17. 2. Security Bond:

  • Security Deposit: A refundable security deposit of $1,500 is required at the time of vehicle pickup. This deposit will be held to cover any potential damages, traffic violations, or other charges that may arise during the rental period. The deposit will be refunded upon return of the vehicle in satisfactory condition, subject to the terms outlined below.
  • Security Bond: A security bond of $1,500 is required, which will be held in addition to the security deposit.
